As to the shoplifter.

When do you consider the crimes beyond the shoplifting? At what point are those a consideration?

Would it be bad that a shoplifter brought a handgun on his shoplifting spree? Maybe he had other intentions for it, maybe selling it on his way home with his stolen goods? But still a felony to be in possession of a concealed handgun while committing a crime.

Maybe when he committed felony menacing by pointing said handgun at the police?

Or when he committed a burglary of a residence while armed with said handgun? Also while attempting to elude/escape the police (crime) while armed.

Misdemeanor offenses are one thing but felonies are a different matter. Because of the threat to the general public they cannot be ignored. In fact because of the Officers job, there is a duty to act that the general public is not held to.

An Officer fails to act and someone gets hurt, they can be held personally liable as well as the city/county.
