Log Man, I have long talked about this scenario, and Namelus and a couple of others could quote me on a couple of different sites.
Namelus, I haven’t seen the police report, so if you have a copy handy I would appreciate seeing it. I am going off the news reports and going with their story and how it would have been charged/prosecuted when I was in the business, according to the laws of Colorado at the time.
Your calling what I put down as BS, why don’t you explain where I went wrong and show me such if you wouldn’t mind.
Yes the initial charge is shoplifting, but he was armed at the time. The fact that he didn’t use the handgun during that crime left it shoplifting and not armed robbery, and my continuing use of the shoplifting term.
And again, when he committed the felony by pointing the handgun at the officers, the game was changed. If you want to continue to argue the petty offense at that point, there is nothing more that I can explain.
