Ok, one last time.
Yes the original charge and issue was shoplifting, we can agree on that. However that is not why the rest of the situation occurred.
Man points formerly concealed handgun at the police. That is a felony. That is a reason to pursue and apprehend the suspect. No, he doesn’t have to fire the handgun for the threat to be realized. This is felony menacing.
The possession of a handgun during a crime, even when it is not used can and is often charged. And we can assume that the gent didn’t have a CCW permit.
In Colorado, breaking into someones house is trespassing, unless you undertake another crime such as attempted escape, eluding, theft, etc., while in the house, then the charge would be burglary.
There is more to this than the shoplifting. I would suggest actually reading the statutes to see what violations are actually appropriate.
Another thing, additional charges can be brought as the evidence is gathered, and likely will be/have been.
Before you call BS and dismiss what I have to say, you might want to look at the laws.
